True Essence Living

These Terms & Conditions ("Terms") govern the relationship between Patricia Higgins and Clinton Higgins trading as True Essence Living (ABN: 27 309 936 532) ("we," "us," "our," "True Essence Living") and any individual or entity ("you," "your," "Client") who purchases or uses our services, programs, memberships, or products.

By engaging with our services, making a purchase, or accessing our content, you agree to be bound by these Terms.

1. SERVICES OFFERED

True Essence Living provides energetic healing, spiritual guidance, coaching, educational programs, memberships, and related wellness services including but not limited to:

Individual sessions (including Unbraced Sessions, Magnetic Centre sessions)
Group programs (including UNBRACED Program and future programs)
Membership communities (including Align + Activate, Radiant Presence, Embodied Empire)
Digital products and courses
Free resources (including Golden Orb)
Any future services, programs, or products we may offer

2. PAYMENT TERMS

2.1 Payment Processing

Payments are processed through Stripe and/or PayPal. By providing payment information, you authorise us to charge your selected payment method for the full amount of your purchase.

2.2 Payment Due Dates

Single sessions and programs: Payment due in full at time of booking unless payment plan is specifically arranged
Memberships: Payment due on the date of initial purchase and automatically on each renewal date thereafter
Payment plans: As specifically outlined in your payment plan agreement

2.3 Currency

All prices are quoted in Australian Dollars (AUD) unless otherwise specified.

3. REFUND POLICY

3.1 General No-Refund Policy

All sales are final. We do not offer refunds for:

Individual sessions
Digital products
Single-payment programs
Membership fees (including monthly or annual memberships)

3.2 Limited Exception for Multi-Session Packages

For multi-session packages only: Refunds may be considered after the first session has been completed, but no refunds will be provided once you have progressed beyond the first session in your package. Any approved refunds will be for unused sessions only, calculated on a pro-rata basis.

3.3 Technical Issues

If you experience technical difficulties preventing access to digital content due to issues on our end, we will work to resolve the issue or provide alternative access. This does not constitute grounds for a refund.

4. CANCELLATION & RESCHEDULING

4.1 Individual Sessions

Cancellations must be made at least 2 hours prior to your scheduled session start time. Cancellations made with less than 2 hours notice will result in forfeiture of the session with no refund available.

4.2 Membership Cancellations

You may cancel recurring memberships by providing at least 7 days written notice before your next renewal date. Cancellations received with less than 7 days notice will be processed for the following billing cycle.

4.3 Rescheduling

Session rescheduling is permitted with at least 2 hours notice. We will make reasonable efforts to accommodate rescheduling requests based on availability.

5. INTELLECTUAL PROPERTY

5.1 Ownership

All content, methodologies, frameworks (including but not limited to The Energetic Architecture Method™), programs, courses, written materials, audio recordings, videos, and intellectual property created by True Essence Living remain our exclusive property.

5.2 Limited License

When you purchase our services or programs, you receive a limited, non-exclusive, non-transferable license to use the materials for your personal use only. You may not:

Share, distribute, or sell our proprietary content
Copy, reproduce, or create derivative works
Use our content for commercial purposes
Record, screenshot, or distribute session content

5.3 Trademark Protection

"True Essence Living," "The Energetic Architecture Method™," and other proprietary terms are trademarks of our business. Unauthorized use is prohibited.

6. HEALTH & WELLNESS DISCLAIMERS

6.1 Not Medical Advice

Our services are for educational and spiritual guidance purposes only. Nothing we provide constitutes medical, psychological, or therapeutic advice. We are not licensed medical or mental health professionals.

6.2 Personal Responsibility

You are responsible for your own health and wellbeing. You should consult qualified healthcare professionals for any physical or mental health concerns. Our energetic and spiritual guidance work complements but does not replace professional medical or psychological care.

6.3 Individual Results

Results from our programs and sessions vary by individual. We make no guarantees about specific outcomes, healing results, or transformation timelines.

6.4 Participation at Own Risk

Participation in our programs, sessions, and communities is at your own risk. By engaging with our services, you acknowledge that spiritual and energetic work can bring up emotions, memories, or physical sensations.

7. CONFIDENTIALITY & PRIVACY

7.1 Client Confidentiality

We maintain strict confidentiality regarding your personal information, session content, and any private communications. We will not share your personal details without your explicit written consent, except as required by law.

7.2 Testimonials & Case Studies

Any use of your experience as testimonials or case studies will only occur with your explicit written permission. We may share general insights from our work without identifying specific clients.

7.3 Privacy Policy

Our collection and use of personal information is governed by our Privacy Policy, available on our website.

8. CONDUCT & PARTICIPATION

8.1 Respectful Participation

All clients are expected to participate respectfully in sessions, programs, and membership communities. Harassment, inappropriate behavior, or disrespectful conduct toward facilitators or other participants is not tolerated.

8.2 Commitment to Growth

Our programs require active participation and commitment to your personal growth process. We reserve the right to remove participants who are not engaging constructively.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by Australian law, True Essence Living, Patricia Higgins, and Clinton Higgins shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to loss of profits, data, or business interruption.

Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid for the specific service giving rise to the claim.

10. FORCE MAJEURE

We are not responsible for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, internet outages, or technical failures.

11. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of New South Wales.

12. MODIFICATIONS

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a new "Last Updated" date. Continued use of our services after posting of updated Terms constitutes acceptance of the changes.

13. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

14. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any specific service agreements, constitute the entire agreement between you and True Essence Living regarding your use of our services.
