By purchasing, booking, or participating in any service offered through Empowered & Out Coaching, you agree to the following Terms & Conditions. Please read them carefully before using this website or enrolling in any coaching service or program.
1. Services
Empowered & Out Coaching provides coaching services, programs, consultations, and educational resources designed to support personal and professional growth, including confidence-building, purpose discovery, and career development.
All services are intended for educational and personal development purposes only.
2. Not Therapy, Medical Care, or Legal/Financial Advice
Coaching is not therapy, counseling, mental health treatment, legal advice, financial advice, or medical care.
By participating in coaching, you understand that Empowered & Out Coaching does not diagnose, treat, or prevent any mental health or medical condition, and does not provide licensed legal, tax, or financial advice. You agree to seek an appropriate licensed professional for those needs when necessary.
3. Eligibility
You must be at least 18 years old to use this website or purchase coaching services.
By booking or purchasing services, you confirm that you are legally able to enter into a binding agreement.
4. Payments
Payment is due at the time of purchase unless a payment plan has been agreed to and offered through the checkout process.
If you choose a payment plan, you agree to complete all scheduled payments until the full balance is paid. Payment plans are commitments to pay the full program fee and are not subscriptions that can be canceled after services begin.
If any payment is missed, declined, or overdue, Empowered & Out Coaching reserves the right to pause access to coaching sessions, materials, scheduling, and program content until the account is made current.
5. Refund Policy
All sales are final unless otherwise stated in writing.
Because coaching services involve reserved time, preparation, and access to materials, refunds are not provided for completed sessions, partially used packages, missed appointments, change of mind, scheduling conflicts, or lack of participation.
If a specific offer includes a separate written refund policy, that policy will apply to that specific offer.
6. Scheduling and Cancellations
Clients are responsible for scheduling sessions through Paperbell or the designated booking platform.
To reschedule a session, at least 24 hours notice is required. Sessions missed without sufficient notice may be considered forfeited and are not refundable.
If Empowered & Out Coaching needs to reschedule due to illness, emergency, or unforeseen circumstances, every reasonable effort will be made to reschedule promptly.
7. Session Expiration
Coaching sessions and packages must be used within the timeframe stated in the offer, package, or agreement.
Unless otherwise stated in writing, any unused sessions expire after 1 year from start of coaching program start date and are forfeited without refund.
8. Client Responsibility
Coaching is a collaborative process. Your results depend on your own commitment, effort, decisions, and follow-through.
By participating in coaching, you accept full responsibility for your physical, mental, emotional, financial, and professional well-being, as well as your choices, actions, and results.
9. No Guarantees
Empowered & Out Coaching does not guarantee any specific outcome or result.
This includes, but is not limited to, job offers, promotions, career changes, financial results, confidence growth, clarity, or personal transformation. Any testimonials or examples shared are illustrative only and do not guarantee similar results.
10. Confidentiality
Information shared during coaching sessions will be treated with respect and kept confidential to the extent permitted by law.
However, confidentiality may be broken if disclosure is required by law or if there is reason to believe there is a risk of harm to yourself or others.
If you participate in any group setting, you also agree to respect the privacy and confidentiality of other participants.
11. Intellectual Property
All content, materials, templates, worksheets, workbooks, videos, guides, frameworks, branding, and resources provided by Empowered & Out Coaching are the property of JMB Coaching LLC unless otherwise stated.
These materials are for your personal, non-commercial use only. You may not copy, reproduce, republish, distribute, modify, sell, share, or teach from these materials without prior written permission.
12. Website and Platform Use
You agree to use this website and any related platforms lawfully and respectfully.
You may not misuse the site, attempt unauthorized access, interfere with the functionality of the website or platform, or use any content for unlawful purposes.
Empowered & Out Coaching reserves the right to restrict or terminate access to services or content if these Terms are violated.
13. Third-Party Platforms
Empowered & Out Coaching may use third-party tools and platforms such as Paperbell, Zoom, payment processors, scheduling systems, email providers, and file-sharing tools.
We are not responsible for service interruptions, outages, technical failures, or data issues caused by third-party providers, though reasonable efforts will be made to maintain service continuity.
14. Limitation of Liability
To the fullest extent permitted by law, JMB Coaching LLC and Empowered & Out Coaching will not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of this website, participation in coaching services, or reliance on any materials provided.
Your use of the website and services is voluntary and at your own risk.
To the fullest extent permitted by law, any liability shall be limited to the amount you paid for the specific service at issue.
15. Indemnification
You agree to indemnify and hold harmless JMB Coaching LLC, Empowered & Out Coaching, and its owner, representatives, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses arising from your use of the website, participation in services, breach of these Terms, or violation of any rights of another party.
16. Termination of Services
Empowered & Out Coaching reserves the right to refuse, suspend, or terminate services at any time if there is nonpayment, abusive behavior, repeated no-shows, inappropriate conduct, or any other circumstance that makes the coaching relationship no longer appropriate.
If services are terminated due to a violation of these Terms, no refund will be provided unless required by law.
17. Privacy
Your use of this website and services may also be subject to a separate Privacy Policy. By using this site, you acknowledge that you have reviewed and accepted any posted Privacy Policy.
18. Governing Law
These Terms & Conditions are governed by the laws of the State of Colorado, without regard to its conflict of law rules.
Any disputes arising out of these Terms or the services provided shall be resolved in the appropriate courts located in Arapahoe County, Colorado, unless otherwise required by law.
19. Changes to These Terms
Empowered & Out Coaching reserves the right to update these Terms & Conditions at any time. Any changes will be effective immediately upon posting the revised version on the website with the updated effective date.
Your continued use of the website or services after changes are posted constitutes your acceptance of those changes.
