1.0 Description of Coaching
 
Coaching is a partnership (defined as an alliance, not a legal business partnership) between the Coach and the Client in a thought-provoking and creative process that inspires the client to maximize personal and professional potential. It is designed to facilitate the creation/development of personal, professional, or business goals and the development and implementation of a strategy/plan for achieving those goals.

2.0 Confidentiality
 
  1. During the coaching relationship, the Client may share plans, business dealings, and other proprietary information with the Coach. The Coach will not at any time, directly or indirectly, use any such information for the Coach’s benefit. The Coach will not give out the Client's name without the Client’s consent. The coaching relationship is confidential unless the Client discloses information to a third party.  This confidentiality statement shall be as personal as the applicable provincial or federal laws and the Client’s company policy, if applicable, allows. The Coaching relationship is not privileged, and, as such, a Coach’s records on a Client can be subpoenaed.  
  2. The Client is responsible for ensuring confidentiality in the environment where coaching will be received.    This includes awareness of voice-activated personal assistants like ‘Alexa’ or ‘google home.’  The Coach is responsible for ensuring confidentiality in the environment where coaching is given per prevailing local laws.  The Coach agrees to turn off any microphones intended for non-coach communication purposes. 
 
3.0 Release of Information
 
By proceeding with a booking, the Parties agree that the Coach may share the Client’s name, contact information, and start and end dates with an accreditation organization such as the International Coaching Federation (ICF). The Parties agree that this information is shared with the sole and necessary purpose of verifying the coaching relationship.  Verifying the coaching relationship is vital for maintaining the Coach’s training, education, and adherence to the code of ethics set forth by an accrediting organization.  The Parties also agree that only broad themes and topics may be anonymously and hypothetically shared with other coaching professionals for training, mentoring, evaluation, professional development, and consultation purposes.      
 
4.0 Nature of Relationship
 
  1. Coach agrees to maintain the ethics and standards of behaviour established by the International Coach Federation “(ICF)” (Coachfederation.org/ethics). It is recommended that the Client review the ICF Code of Ethics and the applicable standards of behaviour.
  2. Client is solely responsible for creating and implementing their physical, mental, and emotional well-being, decisions, choices, actions, and results arising from or from the coaching relationship, coaching calls and interactions with the Coach. As such, the Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction or any direct or indirect result of any services provided by the Coach. The client understands coaching is not therapy, does not substitute for treatment if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
  3. Client further acknowledges that they may terminate or discontinue the coaching relationship at any time.
  4. Client acknowledges that coaching is a comprehensive process involving different areas of their life, including work, finances, health, relationships, education, and recreation. The Client agrees that deciding how to handle these issues, incorporating coaching principles into those areas, and implementing choices is exclusively the Client’s responsibility.
  5. Client acknowledges that coaching does not involve diagnosing or treating mental disorders as defined by the American Psychiatric Association. That coaching is not to be used as a substitute for counselling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals. The Client’s exclusive responsibility is to seek such independent professional guidance as needed. Suppose the Client is currently under the care of a mental health professional. In that case, it is recommended that the Client promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by the Client and the Coach.
  6. The Client understands that to enhance the coaching relationship, the Client agrees to communicate honestly, be open to feedback and assistance and create the time and energy to participate fully in the program.
  
5.0 Waiver of Liability and Indemnity Agreement
 
In consideration of participating in executive coaching personal development, the Client does hereby release, waive, covenant not to sue, and discharge the Coach from liability for all claims resulting in adverse business results and actions.  The Client shall agree to indemnify and hold harmless the Coach from any claims, actions, suits, procedures, cost, expenses, damages, and liabilities, including Lawyer’s fees brought from involvement with the Coach.  By signing and initialling this contract, the Client acknowledges that they have read this waiver of liability and indemnity agreement, fully understand its terms, and fully understand that they are giving up substantial rights, including the right to sue.  The Client also acknowledges that they agree freely and voluntarily by signing this contract.  

6.0 Cancellation Policy:

Your session is reserved just for you.  A late cancellation or missed visit leaves a hole in your Coach's day that could have been filled by another professional.   Empowered Synergy reserves the right to bill or debit a cancellation within 24 hours.
