Purpose and Scope of Offered Services
- The Practitioner agrees to provide coaching services to the Client, designed to assist the Client in identifying and achieving personal, professional, and/or relationship goals. These services are a collaborative process that supports the Client in gaining clarity, developing strategies, and taking action towards their desired outcomes.
- The Client understands that coaching is a partnership and that the Practitioner is not a licensed therapist, counselor, psychologist, or medical professional. Services offered here are not a substitute for, nor intended to diagnose, treat, or cure any mental health condition, medical condition, or provide financial, legal, or other professional advice. The Client agrees to seek professional advice from relevant licensed professionals when needed.
- The Client acknowledges that results are not guaranteed and are dependent on the Client's active participation, commitment, and willingness to implement strategies and insights gained during the engagement. The Practitioner acts as a facilitator, advisor and guide; the Client is solely responsible for their own decisions, actions, and results.
Engagement Sessions
- Format: Engagement sessions will be conducted via video call (Zoom, GoogleMeet), phone call, in-person, or a combination thereof. The specific platform for virtual sessions will be Google Meet.
- Duration and Frequency: Each engagement session is outlined according to the package chosen by the client. Sessions will typically be 60 minutes in duration and occur weekly, bi-weekly or monthly at a mutually agreed-upon time. Other durations and frequencies are outlined in the corresponding purchsed or gifted package.
- Scheduling: Sessions will be scheduled by the Client using our online scheduling platform. The Client is responsible for booking their sessions within the agreed-upon timeframe through their online account.
- Client's Responsibility: The Client agrees to arrive on time for scheduled sessions and be prepared to actively participate. This may include completing interventions, "growthwork" or reflections provided by the Practitioner between sessions.
Cancellation and Rescheduling Policy
- Client Cancellations/Rescheduling: The Client agrees to provide at least 24 hours' notice to the Practitioner if they need to cancel or reschedule a session.
- Late Cancellations/No-Shows: If the Client cancels or reschedules with less than 24 hours' notice, or fails to show up for a scheduled session, the session will be forfeited and no refund will be offered for that session. If the client fails to show up for two sessions with no notice given to the Practitioner, the Client will no longer be able to schedule any future sessions with the company.
- Practitioner Cancellations/Rescheduling: In the rare event that the Practitioner needs to cancel or reschedule a session, the Practitioner will provide as much notice as possible and work with the Client to reschedule the session promptly.
Fees & Payment
- Payment Terms: Payment for services is due in full prior to the first session or in installments as per an agreed payment plan. All payments are to be made via online client portal or company website. No late payments are accepted.
- Returned Payments: If any payments are returned services will be discontinued and full amount for all rendered services will be due in full plus any banking fees incurred by company.
- Refund Policy: All fees paid are non-refundable.
Confidentiality
- The Practitioner agrees to keep all information shared by the Client confidential, subject to the exceptions outlined below. This includes personal information, business details, and discussions during engagements.
- Exceptions to Confidentiality: Confidentiality may be limited and information may be disclosed according to the American Psychological Association's (APA) Code of Conduct and under the following circumstances: * If the Practitioner believes there is an imminent and verifiable threat of harm to the Client or others. * If the Practitioner suspects abuse or neglect of a child, elder, or dependent adult. * If required by a court order or other legal process. * If the Client provides explicit written consent for information to be shared. * For purposes of professional supervision or consultation with other practitioners, where the Client's identity remains protected.
Intellectual Property
- All materials, handouts, workbooks, exercises, or other intellectual property provided by the Practitioner to the Client during any engagement remain the sole property of the Practitioner.
- The Client is granted a non-exclusive, non-transferable license to use these materials for their personal or professional development in connection with the offered services. The Client agrees not to reproduce, distribute, modify, or sell these materials without the express written consent of the Practitioner.
Limitation of Liability
- The Client acknowledges that offered services are not without inherent risks, and the Client freely and voluntarily assumes all risks associated with participation in the process of the offered services.
- In no event shall the Practitioner be liable to the Client for any indirect, consequential, incidental, special, punitive, or exemplary damages, including but not limited to loss of profits, revenue, data, or use, arising out of or in connection with the offered services, even if the Practitioner has been advised of the possibility of such damages.
- The Practitioner's total liability shall not exceed the total amount of fees paid by the Client to the Practitioner for the services provided under this Agreement.
