EMPOWERED Recovery and Wellness — Terms & Conditions (Version 1.0)

These Terms & Conditions (“Terms”) govern your use of services and digital content provided by EMPOWERED Recovery and Wellness (“EMPOWERED Recovery and Wellness,” “we,” “us,” “our”). By booking a session, purchasing a package, or accessing our content, you agree to these Terms.

1) Services are Education/Coaching/Consulting — Not Medical Care

EMPOWERED Recovery and Wellness provides education, coaching, and consulting related to breast cancer survivorship topics (including lymphedema risk education and shoulder/radiation-related functional concerns). Services are for general educational purposes and do not include medical diagnosis, medical treatment, physical therapy evaluation or treatment, or individualized therapeutic exercise prescription.

EMPOWERED Recovery and Wellness does not establish a provider–patient relationship through coaching/education sessions. If you need medical advice, diagnosis, treatment, urgent care, or individualized rehabilitation services, you should consult a licensed healthcare provider. If you experience emergency symptoms, call 911 or seek emergency care.

2) No Guarantees; You Are Responsible for Your Decisions

Any information shared is intended to support informed decision-making. Outcomes vary by individual, and no guarantees are made regarding results. You remain responsible for your health decisions, activity choices, and use of any information provided.

3) Referrals and Collaboration

When appropriate, EMPOWERED Recovery and Wellness may recommend that you consult a licensed medical provider (e.g., physician, physical therapist, occupational therapist) and/or a qualified fitness professional for individualized assessment, treatment, or training programming. Any third-party services are independent of EMPOWERED Recovery and Wellness.

4) Eligibility and Appropriate Use

By using EMPOWERED Recovery and Wellness services, you represent that you are at least 18 years old (or booking with a parent/guardian where permitted) and that you will use services only for lawful, appropriate purposes.

5) Scheduling, Fees, and Payment

All fees are disclosed at booking and are due at the time of purchase unless otherwise stated. Services are not insurance-billed and are paid out-of-pocket.

6) Cancellation / Rescheduling Policy

You may reschedule or cancel according to the booking policy shown at checkout. Cancellations or reschedule requests made less than 24 hours before the scheduled start time will be charged the full cost of the session. If you do not attend a scheduled session without canceling within the permitted timeframe, the session may be forfeited.

7) Packages and Expiration (if applicable)

If you purchase a multi-session package, sessions must be used within the time period stated at purchase (or within a reasonable period if not stated). Unused sessions are non-transferable unless explicitly permitted in writing.

8) Intellectual Property

All materials, session frameworks, handouts, and digital content provided by EMPOWERED Recovery and Wellness are owned by EMPOWERED Recovery and Wellness and are for your personal or internal professional use only. You may not reproduce, distribute, or sell any content without written permission.

9) Confidentiality and Privacy

EMPOWERED Recovery and Wellness respects your privacy. However, coaching/education services may not be covered by HIPAA in the same way as clinical care. Please avoid sharing highly sensitive information unless necessary. We recommend you use a private location and secure internet connection for virtual sessions. 10) Technology and Recording

Virtual sessions may be delivered through third-party platforms. You are responsible for having adequate internet access and a private environment. No recording of sessions by you is permitted without written consent. EMPOWERED Recovery and Wellness may record only with your explicit permission in advance.

11) Booking/Payment Platform (Paperbell)

Sessions and packages may be scheduled and paid for through Paperbell, a third-party booking and payment platform. EMPOWERED Recovery and Wellness is not responsible for third-party platform outages, interruptions, or errors. 13) Limitation of Liability

To the fullest extent permitted by law, EMPOWERED Recovery and Wellness is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of services or content. EMPOWERED Recovery and Wellness’s total liability for any claim will not exceed the amount you paid for the service giving rise to the claim.

14) Dispute Resolution; Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law rules. Any dispute will be resolved in the state or federal courts located in Minnesota unless otherwise required by law.

15) Changes to These Terms

EMPOWERED Recovery and Wellness may update these Terms from time to time. The “Effective Date” will reflect the most recent version. Continued use of services after updates constitutes acceptance.
